Brawley Woods Halloween Haunted Walk Waiver RELEASE, INDEMNIFICATION, AND HOLD HARMLESS AGREEMENT I on behalf of myself and my children, parents, heirs, assigns, personal representative and estate, and also agree as follows: Below name and/or of Children age of 16 years and under above parent gives consent that is listed on this form above Have full knowledge before participating in Brawley Woods Halloween Haunted Walk located at 1320 Brawley Rd West Whitby L1M 1M9: Brawley Woods Haunted Halloween Walk is an Outside event and must dress to weather conditions and is NOT Responsible for the following: Damage to personal property, or Lost/ Stolen personal belongings. The Holder of a ticket agrees and understands that there are known and unanticipated inherent risk, dangers and hazards in attending Brawley woods. By attending Brawley woods Haunted Halloween Walk, attendees voluntarily accept and assume all such risks, dangers and hazards, and agree to release and hold harmless Brawley woods and its officers, employees, volunteers, and agents from any and all responsibility and/or liability for injury, harm, damage, death, cost of expenses arising directly or indirectly from attending Brawley woods haunt. MEDICAL WARNINGS & DISCLAIMER: NOT WHEELCHAIR OR MOBILITY SCOOTER ACCESSIBLE NOT RECOMMENDED FOR ANYONE WITH A LIMITED MOBILITY (broken leg, crutches, walking cane, balance, vertigo etc.) UNEVEN PATHWAYS MAY HAVE TRIPPING HAZARDS., WALK AT YOUR OWN RISK NO MEDICAL STAFF ONSITE - ENTER AT OWN RISK NO ANIMALS, INCLUDING SERVICES (maybe started by attractions) WILL BE PERMITTED ON THE PREMISES -Will not be able to enter this attraction if you have flue like symptoms -Not recommended for those suffering from conditions such as (but not limited to); Heart conditions, Asthma, Epilepsy, Limited Eye Site, or any other physical, mental, respiratory and or medical condition -Do not enter if you are under the influence of drugs and or alcohol -Not recommended if you have any of the additional following conditions or concerns: -Expecting mothers -Back, Neck or Similar Physical limitations/Conditions -Medical sensitivity to strobe lights -Medical sensitivity to fog effects -Fear of enclosed spaces
Due to its graphic nature, this event may be too sensitive for young children and is not recommended for children under the age of 12 years old. All children must be accompanied by an Adult, as scenes may be extremely graphic and are rated above PG13 Everyone admitted into the Halloween Walk will need to obey the below Rules: This haunted path utilizes low lit scenes, claustrophobic rooms, smoke effects, loud noises, strobe lights, uneven walking surfaces, wet or damp conditions, sudden movements, a physically demanding environment as well as other scary situations that could expose you to risks of injury to your body, emotions, and property. By attending you release your right to any claims against Brawley Woods creators and agents should you be injured or incur damages to yourself and or property. Brawley Woods assumes no liability for any harm resulting from attending this event and rides has forewarned attendees of risks in advance by way of this disclaimer. By entering Brawley woods attraction, you give the right to use your image on all promotional materials RULES AND WARNINGS: Do not touch the actors Do not touch the props or decorations No flashlights, cell phones, lighters or lighting devices of any kind on the trail No Costume masks or props allowed No smoking/vaping open flame on the forest trail or inside building (only in designated areas) No Alcohol/Drugs is not permitted on property No Aggressive behavior towards other patrons, employees or any Staff No cameras allowed on trail No running or pushing or roughhousing is permitted. No large bags allowed on trail Guests are not permitted to carry weapons or sharp objects on the premises. No outdoor food /drinks allowed on property Do not enter if you are not wearing appropriate shoes and clothing. Do not enter if you are pregnant, subject to epileptic seizures, have heart problems etc. Do not touch the walls/wood to avoid splinters You will be exposed to strobe lights, dense fog, low lighting, black lights, tight spaces, loud noises, uncomfortable/disturbing scenes We want you to come back and enjoy the Brawley Woods Haunted Halloween Walk year after year. So, please drive safely both to and from the Brawley Woods Haunted Halloween Walk. Failure to follow posted guidelines may result in serious injury or removal from the attraction Brawley woods reserves the right to refuse admission to anyone at any time you may be asked to leave for inappropriate behavior or violations explained above and will not receive a refund.
PG 3 1. I acknowledge that these activities involve known and unanticipated risks which could result in physical or emotional injury/ Nightmares/emotional trauma, visual problems, ringing in ears, dizziness, headache, fainting, paralysis or permanent disability, death, and property damage. Risks include, but are not limited to broken bones, bruises and other bodily injuries caused by falls or contact with walls, objects or other participants; medical conditions resulting from physical activity; nightmares, damaged clothing or other property, coming in contact or contracting the Covid-19 virus or any other viruses. I understand such risks simply cannot be eliminated, despite the use of safety equipment, without jeopardizing the essential qualities of the activity. 2. I expressly accept and assume all of the risks inherent in this activity or that might have been caused by the negligence of the Releasees. My participation in this activity is purely voluntary and I elect to participate despite the risks. In addition, if at any time I believe that event conditions are unsafe or that i am unable to participate due to physical or medical conditions, then I will immediately discontinue participation. 3. I expressly accept and assume all of the risks inherent in this activity or that might have been caused by the negligence of the Releasees known that this event is in a group setting and that I may come in contact or contract the Covid-19 virus or any other viruses. My participation in this activity is purely voluntary and I elect to participate and release any liability from the Releasees despite the risks 4. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Releasees from any and all claims, demands, or causes of action which are in any way connected with my participation in this activity, or my use of their equipment or facilities or rides, arising from negligence. This release does not apply to claims arising from intentional conduct. Should Releasees or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. 5. I represent that I have adequate insurance to cover any injury or damage I suffer or cause while participating in this activity, or else I agree to bear the costs of such injury or damage myself. I further represent that I have no medical or physical condition which could interfere with my safety in this activity, or else I am willing to assume- and bear the costs of- all risks that may be created, directly or indirectly, by any such condition. 6. An activity release of liability or waiver is a form that participants sign to prove that they’re fully aware of the inherent risks and potential risks in participating in such an activity they are stating that they fully acknowledge the risks involved, and therefore cannot file frivolous lawsuits in case of damages or injury.
PG 4 I HAVE FULLY READ THIS RELEASE PG 1-4 OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, RULES, WARNINGS, AND UNDERSTAND THAT I WILL BE GIVEN UP SUBSTANTIAL RIGHTS BY BUYING A TICKET TO THE EVENT AT MY OWN RISK. The Holder of a Purchased Event ticket agrees and understands that there are known and unanticipated inherent risk, dangers and hazards by attending Brawley woods Haunted Halloween Walk.
